【英文专栏】劳动合同缺乏基本条款可能会带来哪些法律后果?
The employment contract shall specify the following matters:
(1)the name,domicile and representative or principal person in charge of the employer;
(2)the name,address and identity card number of the employee;
(3)the term of the employment contract;
(4)the job descriptions and place of work;
(5)working hours,rest and leave;
(6)remuneration;
(7)social security;
(8)labor protection,working conditions and protection against occupational hazards;
(9)and others that must be included in an employment contract as laws and regulations stipulate.
The essential terms are those that the laws require the employers to stipulate explicitly in the employment contract.If the obligations and rights stipulated are vague,the employer may bear the negative consequences.Moreover,the grave lack of essential terms may be considered that the employer did not conclude a written employment contract with the employee.The employer shall pay the employee twice wages each month in accordance with laws.
